These Terms of Use and Participation Conditions govern access to the TrendZ Art website, registration for the event, submission of materials, preparation of the participant’s digital booth, and participation in TrendZ Art.

By using this website, submitting a registration form, sending participation materials, or completing a payment related to TrendZ Art, the user declares that they have read, understood, and accepted these Terms.

TrendZ Art is an international virtual event created for visual artists and made possible by Art Incentive Foundation, a company of Montfort Lynch Corporation.

1. About TrendZ Art

TrendZ Art is an international virtual event created for visual artists to present their work through a professionally structured digital booth and digital portfolio presentation.

The event is designed to give artists a more organized, accessible, and professional way to present their visual work, artistic identity, portfolio, biography, contact information, and selected materials to visitors, professionals, galleries, collectors, partners, curators, and other audiences who may access the event environment.

Participation may include a digital booth, portfolio presentation, artwork images, artist statement, biography, contact links, and related visual materials, according to the applicable participation condition or plan.

2. Eligibility

Participation in TrendZ Art is available to individuals from any country, provided that they are able to present themselves and submit the required information in English or Portuguese.

Participants must be at least 21 years old at the time of registration.

By registering, the participant declares that the information submitted is true, accurate, and complete, and that they have the legal right to submit the materials provided for use in connection with TrendZ Art.

3. Registration

Registration begins through the official TrendZ Art website by completing the initial registration form and selecting the applicable participation condition or plan.

The initial form is intended to collect essential registration information. After registration, participants may receive additional instructions or a second form requesting the materials and information required for the creation, organization, or publication of their digital booth.

Submitting a registration request does not automatically guarantee participation if required information is incomplete, inaccurate, inconsistent, incompatible with the event requirements, or not provided within the requested timeframe.

TrendZ Art may refuse, pause, limit, or cancel participation when the participant fails to provide required information, submits inappropriate material, does not respond to operational communications, or does not meet the event’s participation requirements.

4. Participation format

Participation in TrendZ Art may include, depending on the applicable participation condition or plan:

• a professional digital booth
• presentation of selected artworks
• artist biography or artist statement
• portfolio images
• artwork descriptions
• links to portfolio, website, social media, or contact channels
• digital visibility during the event period
• continued visibility or additional exposure, when expressly offered
• promotional or visual materials related to participation, when applicable

The exact scope of participation will be the one presented on the official TrendZ Art website, registration page, offer page, payment page, or official communication at the time of registration.

5. Payment

Participation in TrendZ Art requires payment according to the condition, plan, or offer selected by the participant.

Payments may be made through the payment methods made available by TrendZ Art at the time of registration, including third-party payment platforms when applicable.

Where installment payment is offered, the applicable conditions will be those displayed at the time of payment.

Unless expressly stated otherwise, participation is based on a one-time registration condition, with no monthly fee and no recurring charge.

Full payment or compliance with the accepted installment terms must be completed according to the deadline and payment conditions established at the time of registration.

6. No guarantee of artistic, commercial, or professional results

TrendZ Art provides participants with visibility, structured presentation, digital presence, portfolio exposure, and access to the event environment according to the applicable participation condition.

However, TrendZ Art does not guarantee:

• artwork sales
• gallery representation
• collector interest
• invitations
• curatorial selection
• media coverage
• partnerships
• contracts
• commissions
• professional recognition
• commercial opportunities
• financial return
• audience volume
• specific contacts or leads
• any specific artistic, professional, commercial, or financial result

Participation creates an opportunity for organized presentation and visibility. It does not create a guarantee of outcome.

7. Participant materials and responsibility

The participant is solely responsible for the truthfulness, legality, authorship, originality, rights, permissions, and integrity of the information and materials submitted for participation in TrendZ Art.

Submitted materials may include, among others:

• artwork images
• portfolio images
• videos
• artist biography
• artist statement
• artwork titles
• artwork descriptions
• links
• contact information
• studio name or artist name
• files, texts, captions, or other materials related to the participant’s booth

By submitting materials, the participant declares that they have the necessary rights, permissions, licenses, and authorizations to use, display, publish, share, and submit such materials in connection with TrendZ Art.

The participant also declares that submitted materials do not violate third-party rights, intellectual property rights, image rights, privacy rights, contractual obligations, confidentiality obligations, or applicable law.

8. Use of submitted materials

By submitting materials to TrendZ Art, the participant authorizes TrendZ Art, its team, service providers, technical partners, and operational representatives to use, organize, adapt, format, resize, display, publish, reproduce, and present the submitted materials as necessary for:

• registration processing
• event organization
• digital booth preparation
• portfolio presentation
• visual consistency
• participant identification
• event communication
• promotional materials related to the participant’s participation
• website display
• event-related digital environments
• administrative and operational purposes connected to TrendZ Art

This authorization is limited to the purposes connected with the participant’s registration, booth, event presence, promotional visibility, and operation of TrendZ Art.

The participant remains the owner of their original artworks and submitted intellectual property, except where expressly agreed otherwise in writing.

9. Digital booth and event presentation

The participant’s materials may be used to structure a digital booth, presentation page, portfolio area, or related digital presence within TrendZ Art, according to the applicable participation condition and operational model of the event.

TrendZ Art reserves the right to organize, format, crop, resize, edit layout presentation, adapt visual hierarchy, adjust text formatting, and arrange submitted materials for consistency, quality, technical compatibility, and event presentation standards, provided that the essential nature of the participant’s work is respected.

The participant understands that the booth is a presentation structure prepared for event visibility and may not be a fully customized website, exclusive platform, personal store, or individually controlled digital asset unless expressly stated otherwise in the applicable offer.

10. Review, refusal, suspension, or removal of materials

TrendZ Art may refuse, suspend, limit, edit, hide, or remove materials that are, in its reasonable judgment:

• unlawful
• misleading
• offensive
• discriminatory
• violent
• defamatory
• infringing
• unauthorized
• incomplete
• low quality
• technically unsuitable
• inconsistent with the event’s standards
• incompatible with the event’s audience
• submitted after the required deadline
• harmful to the event, other participants, visitors, partners, or the organization

This may occur without creating any automatic right to refund, especially when the issue results from the participant’s own conduct, delay, incomplete submission, inaccurate information, or lack of rights over the submitted material.

11. Participant obligations

The participant agrees to:

• provide accurate and complete information
• submit required materials within the requested deadlines
• respond to operational communications when necessary
• ensure that all submitted materials are authorized for use
• avoid submitting false, misleading, unlawful, or infringing content
• respect the event’s technical and operational requirements
• use the website and event environment lawfully and in good faith
• not interfere with the operation of the website, forms, payment tools, event systems, or digital presentation structure

Failure to comply with these obligations may result in limitation, suspension, adaptation, or cancellation of the participant’s presentation, without automatic refund.

12. Communications

By registering, the participant authorizes TrendZ Art to send communications related to registration, payment, event instructions, material submission, booth preparation, operational updates, participation management, and event-related matters through the contact details provided, including email and WhatsApp where applicable.

The participant is responsible for providing accurate contact information and checking messages, emails, spam folders, and communication channels used during the registration and preparation process.

13. Cancellation and refunds

As a general rule, registrations and participation fees are non-refundable after registration and payment confirmation.

The applicable cancellation and refund rules are described in the TrendZ Art Cancellation and Refund Policy, which forms part of these Terms by reference.

Nothing in these Terms shall limit any mandatory rights granted under applicable law. Where the law requires cancellation rights, withdrawal rights, or refunds, such rights will be respected in accordance with the applicable legal framework.

Outside legally mandatory situations, any exception to the no-refund rule will be solely at the discretion of TrendZ Art and must be expressly approved in writing.

14. Limitation of liability

TrendZ Art will make reasonable efforts to operate the website, event environment, digital booth structure, participant presentation, and related digital systems as described.

However, TrendZ Art does not guarantee uninterrupted availability of websites, internet services, hosting providers, payment platforms, third-party tools, forms, communication platforms, analytics systems, automation tools, or other internet-dependent resources.

TrendZ Art shall not be liable for:

• indirect losses
• loss of opportunity
• loss of profit
• lack of sales
• lack of contacts
• lack of commercial result
• third-party platform failures
• internet instability
• payment platform issues
• participant failure to submit materials
• participant delay or non-response
• unauthorized materials submitted by the participant
• results not achieved by the participant

15. Third-party services and links

The TrendZ Art website, registration process, payment flow, communication channels, or participant booth may use or link to third-party tools, platforms, websites, payment providers, social networks, portfolio links, or external services.

TrendZ Art is not responsible for the content, policies, availability, security, technical operation, or actions of third-party websites, services, platforms, or tools.

Participants and users should review the applicable terms and privacy policies of third-party services they choose to access or use.

16. Website use

Users agree to use the TrendZ Art website lawfully and in good faith.

Users must not:

• interfere with website operation
• submit false information
• misuse forms, payment tools, or communication channels
• attempt unauthorized access
• copy, scrape, attack, overload, or disrupt the website
• use the website for unlawful, misleading, harmful, or abusive purposes

TrendZ Art may restrict, suspend, or block access to users who misuse the website or interfere with its operation.
